In the United States, there are several services and acts that define the legislation. One such act is called Child Support Recovery Act (CSRA), which makes it a Federal misdemeanor offense for a person who fails to pay a financial obligation. When the person responsible for paying child support refuses to pay for over 2 years, or has the entire sum greater than 2,500$, the state will treat the parent as a criminal. In some cases, the state may take that person’s passport and prevent him/her from leaving the country until all debt is paid.

The following measures may be taken against the parent:
  • Garnishment of rights
  • Jail time
  • Suspension of professional driver’s license
  • Contempt order
  • Liens against property or real estate
  • Freezing bank accounts

Most of the time, a non-custodial parent is sent a notice explaining a time for payment and an explanation, along with the instructions for how to comply. Depending on the amount the parent owes, the state may take actions against the parent. If these administrative penalties (passport ban, driver’s license suspension, frozen bank account, etc.) fail to induce payment, the parent will most likely face probation or even jail time.
